By accessing and/or utilizing any of RIPALIA’s websites located at https://potion.fi, https://potion.finance, https://kelly.finance (or any replacement URL from time to time) (collectively, “RIPALIA Sites”), any such user of any of RIPALIA Sites (the “User”) confirms and consents to be bound by these Potion Landing Page Terms and Conditions as well as any terms and conditions referenced on the respective RIPALIA Sites and all of the terms and conditions incorporated therein by reference (collectively, the “Website Terms & Conditions”).

The Website Terms & Conditions may be amended and/or updated at any time from time to time at the sole discretion of RIPALIA, and the amended versions will be considered effective as of the date and time published on the relevant RIPALIA Sites. RIPALIA may or may not choose to provide the User with a summary of changes by email or otherwise at its discretion or update the date near the top of the Website Terms & Conditions. Any amendment or update to the Website Terms & Conditions is considered effective whether or not an email or any other notice thereof is sent to the User.

The User should not construe any such information or other material as legal, tax, investment, financial, or other professional advice, nor does any such information constitute a comprehensive or complete statement of the matters discussed or the law relating thereto. Nothing contained on this and/or other RIPALIA Sites constitutes a solicitation, recommendation, endorsement, or offer by RIPALIA or any third party service provider to buy or sell any securities or other financial instruments in this or in any other jurisdiction.

All information provided on this and/or other RIPALIA Sites is information of a general nature and does not address the circumstances of any particular individual or entity. • RIPALIA is the original developer of the smart contracts, associated interfaces and other software constituting the Potion Protocol (the "Code"); and
• RIPALIA may open source the Code in parts or in full in any way RIPALIA sees fit; and
• RIPALIA has not been, is not and will not be the deployer, maintainer or operator of any instances of the Code at any time in the past, present or future; and
• in case RIPALIA decides to open source the Code, it will be released "as is", without warranty of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose and noninfringement; and
• in no event shall RIPALIA or the authors of the Code be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the Code or the use of or other dealings in the Code; and
• RIPALIA is not going to retain any control or sufficient influence over the Code or any platform or venue on which the Code may be deployed or used after RIPALIA has open-sourced the Code; and
• RIPALIA is not going to establish or maintain a business relationship with any parties making use of the Code in a way that is not fully compliant with any applicable regulations, including financial and tax regulations; and
• RIPALIA does not retain the sole rights to use the Code once the latter is open-sourced; and
• RIPALIA will not remedy any errors or bugs that may arise in the Code, if RIPALIA finds that such a remedial action would constitute exercise of control or sufficient influence over the Code; and
• following the open-sourcing of the Code, RIPALIA is not going to make any decisions with regard to or in connection with the use of the Code; and
• notwithstanding any unintended security issues in the Code, with regards to which RIPALIA makes no warranties whatsoever, RIPALIA has not programmed any backdoors into the Code (or otherwise) through which RIPALIA would have the ability to influence the operation or use of the Code; and
• where the Code is used by any person or entity, RIPALIA will not earn any profit from transactions or other activity brokered through the Code; and
